- Abstract
The article reflects on the role of the courts in changing the dispute resolution criteria by considering the way the judiciary has adopted to approach alternative dispute resolution (ADR) and its benefits for litigants and the public. It further addresses the enacted pre-litigation requirements applicable in the federal jurisdiction and in some New South Wales courts. It also discusses the role of judges in the ADR.
