- Abstract
The article discusses the judicial selection system in the U.S. It says that 32 states in the country have used contested elections to select judges at some level of their court and 21 states elect all the judges. It notes that legislature in Virginia and South Carolina is responsible for selecting the judiciary while in other states, they utilize the merit selection system and adopted the federal system in which state governor is accountable for the selection process. It mentions best practices in selection systems featured in the position statement of the Institute for the Advancement of the American Legal System (IAAKS) including politically balanced nominating commissions with a majority of non-lawyer members, appointments by the governor and judicial performance evaluations.
