- Abstract
The article discusses judicial deference as of February 2012, focusing on the reaction of courts during wars and emergency situations to the U.S. government's claims of national security. An examination is presented of several cases involving suspected terrorists and U.S. national security claims, including Hamdi v. Rumsfeld. A comparison of judicial deference in cases adjudicated before and after the September 11, 2001 terrorist attacks in the U.S. is also provided.
