- Abstract
Islamic law stipulates that justice should be expressed both during and after the end of the war. This requires that we adhere to the rules not only during the fight but also after the end of the war. This significantly facilitates the transition from a state of war to a period of peace. International law must address the moral sources of the just (legitimate) theory of war nominated by sharia norms, if we are to have one. Islamic law is very advanced in this regard. It definitely takes care of all the dimensions involved in the long and post-conflict (war) period. The physical integrity of the individual, regardless of his status, position and situation in which he finds himself, is protected. Human life, as one of the legal benefits, is sacred and no one has the right to violate, endanger or annihilate it. However, in cases of armed conflict, these undesirable situations also occur. Islamically, the human body and its integrity as a "sacred" human being (in the formal sense) is protected by Islamic legal norms. In the near future care must be taken to develop a just war - just bellum, with a tendency to reduce finding aggressive solutions. Applying and introducing new laws that derive from the Islamic law as the most just, for all states and especially for those who are the forerunners of the so-called "promoters of today's free world", for the immanent need of the time that gradually reach a more peaceful coexistence of different religions, policies and races in this country called "Earth", sensitive, expensive and sacred to all mankind. This activity requires global cooperation, as states individually cannot influence the cessation of hostilities. In today's world, Islamic law theories can have a positive effect on building lasting peace.
