- Abstract
Along with the attacks of 11th September 2001, carried out onto the twin towers in New York and the Pentagon headquarters, a new phase of US policy towards the Middle East began, especially towards Afghanistan. Namely, after these attacks, whose main suspect was Al-Qaeda lead by Bin Laden, very favourable circumstances were created for implementation of the Greater Middle East Initiative. For realization of this purpose, military intervention against Afghanistan was one of the State Department most crucial strategies. Plans for interventions against the Taliban regime in Afghanistan were justified by their assistance and support of the Al-Qaeda organization which, according to American authorities, was responsible for the above mentioned attacks. In this context, there are various dilemmas about the legitimacy of the above mentioned military intervention from the international-legal aspect. Through its' resolutions, UN Security Council never authorized USA or UK, neither NATO, to use force against another country, in this case Afghanistan. In this case also, the criteria for obtaining the right of individual or collective legitimate defence in huge proportions were not reached.
