- Abstract
Royal Decree 665/2023 modifies the Regulation of the Public Hydraulic Domain, the Regulation of Public Water Administration, and Royal Decree 9/2005. These modifications respond to the reforms established in the Council's Proposal for the Implementation Decision regarding the approval of Spain's recovery and resilience plan assessment. The main objective of this decree is to simplify the management of the public hydraulic domain and update the regulatory framework to the new existing pressures on the management of the PHD. Measures are included to reduce administrative burdens and promote environmental recovery after forest fires. It also addresses the management of invasive exotic species and plantations in the public hydraulic domain. The text presents modifications to the Hydrological Planning Royal Decree (RDPH) with the aim of streamlining and homogenizing administrative procedures related to water. A simplified regime is established for the discharge of low-impact wastewater, and the digitization of water use control is promoted. Measures are also included to prevent water pollution due to agricultural activity and criteria are established for the protection of groundwater. In addition, a procedure is established to assess damages and define actions in case of localized contamination of an aquifer. Royal Decree 665/2023 modifies the Regulation of the Public Hydraulic Domain (RDPH) in several aspects. The direct discharge of wastewater is prohibited regardless of its content, and indirect discharges are limited, requiring a hydrogeological study for authorization. A new regulatory framework is established for aquifer recharge, and adjustments are made in flood risk planning and management. The mapping of the public domain is also updated, and discharges from the overflow of the sanitation system during rain episodes in cities are regulated. In addition, aspects of the concessionary regime for water use are addressed, and administrative procedures are improved. The modification came into effect on September 20, 2023.
