- Abstract
The article discusses 'The North Carolina Racial Justice Act' which enacted the Racial Justice Act (RJA) in 2009 in the case of McCleskey and Batson. The act defines the use of statistical evidence which is important in determining whether racial discrimination could challenge death penalty. It describes the case of McCleskey and Batson, and also mentions the disadvantages of McCleskey in the case, indiating that the litigation might solve the issues related to RJA in the future.
