- Abstract
This article reports on a court ruling given in the case "People's Security Life Insurance Co. versus Monumental Life Insurance Co., 867 F.2d 809, 4th Circuit 1989." People's Security Life Insurance Co. and Monumental Life Insurance Co. entered into an agreement imposing a reciprocal hiring moratorium. The agreement contained a clause providing for the arbitration of "any question, charge, complaint, or grievance believed to constitute a breach or violation" of the agreement. People's filed an action against Monumental, seeking a rescission of the contract. Monumental, in turn, moved to stay the proceedings pending arbitration. The district court denied the motion, finding that the arbitration clause did not encompass the issue of fraud in the inducement of the agreement. On appeal, the appellate court determined that the district court's interpretation of the arbitration clause was too narrow.
