- Abstract
The article focuses on the right to exclude in unimproved lands in the U.S. It says that the U.S. Supreme Court has affirmed the inclusion of the right to exclude to property but failed to clarify whether it extends to unimproved lands. It discusses several court cases involving the issue including Kaiser Aetna v. U.S., Nollan v. California Coastal Commission, and Prunyard Shopping Center v. Robins. It also argues on the need for U.S. states to expand public access to the said lands.
