- Abstract
The artile presents the advantages of using intellectual property (IP) mediators who are well-versed in patent law as a good alternative in patent infringement suits. Advantages like providing neutral and informed advise, reducing the learning curve of judges and jurors unfamiliar with patent law and prescribing better remedies are explained. The benefits of avoiding ligation, specially with its unpredictability and high transaction costs, as well as the possibility of settlement that is favorable to patent disputants and society are discussed.
