- Abstract
The article examines the substantial impact concerning the decision of the Boston Housing Authority versus Garcia case to friends and family members of convicted criminals who are living in federally funded public housing in the Commonwealth of Massachusetts. It notes that the innocent and unaware family members and friends who lived with convicted criminals are living with the fear of eviction and face the very real possibility of being homeless. It highlights a review of the historical development of the innocent tenant defense at both the federal and state levels of court.
