- Abstract
This article presents situations which can be included in the Greek-roman epoch within the modern concept of foundations: the private foundations (religious, beneficent and mixed), the public alimentary fundations and the christian charity establishments (venerabiles domus). The first two situations may be included in the concept of dependent foundations or trusts, while the above mentioned establishments may be understood as juridical persons of institutional nature. We emphasize the crisis of juridical person with the actual authors and the prevailing instrumental or nominal concept of juridical person. We apply this concept of juridical person to the venerabiles domus in order to overcome the old discussion among authors as to whether they were true juridical persons.
