- Abstract
The article presents U.S. legal cases and developments in marketing relative to the regulation of product characteristics. The U.S. Federal Trade Commission (FTC) can require manufacturers to reimburse it for the cost of product testing. The tests are done to substantiate product claims or in compliance with industry standards of quality. In reference to packaging and labeling the Warren Corp. v. Goldwert Textile Sales, Inc. and Biltex International Textiles, Inc. case is cited. The case concerned the legal ramifications of mislabeling as it pertains to Lanham Trademark Act.
