- Abstract
THERE EXISTS A COMPLEX dialectic between market and non-market entities that directs the evolution of the legal framework surrounding the international trade of agricultural products since the 19th century. This dialectic, which expresses agricultural specificity, has been particularly enriched in recent decades, especially during conferences and World Summits, as it is regularly updating what we now consider as sustainable development objectives that have been agreed upon at the global level. This puts the Uruguay Round's Agreement on Agriculture into a paradox that ends the agricultural exceptionalism under the General Agreements on Tariffs and Trade of 1947 (GATT of 1947), while taking into account non-trade related concerns, such as food security. The recent results of the continuation of the World Trade Organisation (WTO) negotiations show the possible emergence of an exception related to food security.
