- Abstract
The article focuses on the split in the U.S. circuit court decisions barring fringe benefits recipients from bringing the claims under the Title I of the U.S. Americans with Disabilities Act (ADA). Topics discussed include application of the U.S. Supreme Court Title VII fringe benefits race discrimination case, passage of ADA Amendments Act of 2008 (ADAAA) which allow fringe benefits recipients to bring Title I claims and Title I's antidiscrimination provisions with purposes of the ADA.
