- Abstract
In this paper, I problematize the relationship between law and the state of emergency by using the concept of "security" that Foucault developed in 1977-78 without developing it further. It is paradoxical that emergency law should be declared if we assume that the state of exception has become the norm in today's world. Perceiving the state of emergency from the sole perspective of sovereignty does not allow us to overcome this paradox. But the social field to which Foucault's analysis of security points is marked by neoliberalism in that values and limits become indistinct. I claim that under conditions of neoliberalism, "law" should be reconceptualized as emerging from social development curves in such a way that it no longer stands in a relationship of opposition to any state of exception.
