- Title
CONFUSION FROM THE TAX COURT: THE AMBIGUOUS MEDICAL EXPENSE DEDUCITON.
- Authors
KISTLER, DAVID S.
- Abstract
The article examines the court's judgment for R. G. O'Donnabhain who undergone Sexual Reassignment Surgery (SRS) and deducted the medical expenses on her income tax. The U.S. Internal Revenue Service (IRS) originally approved the deduction but then denied the deduction which pushed O'Donnabhain to file a suit in federal Tax Court. It suggests the need for a legal system to provide standards for analysis of issues on the deductibility of Gender Identity Disorder (GID) and SRS.
