- Abstract
The Enforce and Protect Act (EAPA) was enacted in 2015 to give U.S. Customs & Border Protection (CBP) enhanced tools to enforce U.S. antidumping and countervailing duty (ADD/CVD) laws. The EAPA allows CBP to investigate allegations of ADD/CVD evasion and take enforcement action. Importers are required to exercise reasonable care to determine if their goods are subject to an ADD/CVD order and file the necessary entry with CBP. The EAPA has been used by CBP to identify underpaid ADD/CVD duties. The EAPA investigation process starts when an interested party files an allegation with CBP, and CBP has 90 days to determine if there is a reasonable suspicion of evasion. Interim measures, such as requesting information from importers, may be taken during the investigation.
