- Title
BANKRUPTCY TREATMENT OF INTELLECTUAL PROPERTY ASSETS: AN ECONOMIC ANALYSIS.
- Authors
Menell, Peter S.
- Abstract
The article discusses the possible solutions on the conflict between the intellectual property laws and the bankruptcy system in the U.S. However, the law tries to solve some of these conflicts by recommending several changes to promote a better economic efficiency in the bankruptcy treatment of intellectual property assets. A structured analysis with regard to the underlying policy values of both the Bankruptcy Code and the intellectual property law provides the basis for conflict resolution.
