- Abstract
The article examines judicial skepticism of proposed enforcement decrees with rejection of a proposed agreement between the Securities and Exchange Commission (SEC) and financial services firm Citigroup. Topics discussed include standard of review that limits judicial oversight of proposed enforcement decrees, courts can still police proposed enforcement decrees for substantive unreasonableness and judges give significant deference to agencies' discretionary decisions for enforcement actions.
