- Abstract
The article discusses the court case R (on the application of Kracher) v. Leicester Magistrates' Court wherein Kracher challenged his previous assault conviction by way of judicial review, since the prosecution case was based on the alleged punch involving him and another road user in a previous case. Topics discussed include his previous charge of common assault contrary to section (s.) 39 of the Criminal Justice Act 1988 and the importance of the defendant knowing the case he has to meet.
