- Abstract
The regulation of masculine and feminine sexuality by the Classic Muslim law doesn't respond to moral or procreation concerns, nor even to preservation of an hypothetical “Natural order”. It responds, rather, to the preservation of social order. Therefore, different punishments against sexual transgressions are thought to being strictly applied with harm degree that those transgressions produce. The present article presents this thesis in the context of two axes : the links between fisq, space and sexuality and the relationships between masculinity and sexuality.
