- Abstract
The article provides insights for elder law attorneys on the methods and tools of trust, estate, and elder abuse litigation in the U.S. It emphasizes the need for lawyers to review the terms of the trust and determine if there are no-contest clause prior to taking any action. It describes the purpose of the pleading attack tool to eliminate meritless claims and defenses early. Also discussed are tools to make discovery requests to a party such as interrogatories, subpoenas, and depositions.
