- Abstract
The article explains the U.S. Constitution First Amendment jurisprudence on incitement and examines the constitutionality of riot and incitement to riot in the age of flash mobs. It discusses the U.S. Supreme Courts interpretation of the statutes related to incitement to riot and reflects on its decision in Brandenburg v. Ohio in this context. It highlights the increasing use of social media to organize protests and reflects which crowd behavior should be subject to regulation.
