The article focuses on technology-assisted review (TAR) that uses supervised machine learning and explores the legal consequences of poorly implemented TAR in discovery. It mentions legal consequences of poorly implementing TAR fall into several major categories such as Federal Rules of Civil Procedure, due process violations in the criminal context and criminal prosecution consequences. It also mentions economic costs that companies risk from the misuse of TAR in corporate law.
