California: Who Adjudicates S/L Affirmative Defense?
Abstract
This article discusses a court case wherein the California Supreme Court ruled that it should be the arbitrator who decides whether a statute-of-limitations affirmative defense is applicable to a claim made in arbitration, and not the court. This ruling was prompted by a case in which a Wagner Construction Company sued Pacific Mechanical Corporation for unpaid work.
