- Abstract
The article discusses the legality of providing in-state tuition to illicit immigrants, which was emphasized on the Martinez v. University of California court case. It mentions that a U.S. federal law has banned the offering of in-state educational payments to the undocumented aliens, despite that 10 U.S. states have introduced legislation that compromises the federal rule. The article concludes that the California Supreme Court must accept that the U.S. federal law does not approve the state legislation granting in-state tuition to illegal aliens.
