- Authors
SVENDSEN, MATHIAS ROSE
- Abstract
On 4 May 2021, the Danish Parliament adopted the bill for a so-called Investment Screening Act (Act No. 842 of 10 May 2021) introduced by the Danish Minister for Industry, Business and Financial Affairs. The Investment Screening Act constitutes an entirely new regime in Danish legislation, as thus far foreign direct investments in Denmark have been subject to very limited regulation. As the Investment Screening Act vests rights of severe and intensive interventions to the Danish authorities, this chronicle examines the content of the new Investment Screening Act compared to general principles of administrative law, first of all Danish law on expropriation. Thus, the chronicle first outlines and elaborates on the content of the new Investment Screening Act. Second, and on this basis, the chronicle discusses the provisions of the Investment Screening Act in light of Danish law on expropriation.
