- Abstract
Since 1944, international trade has expanded considerably, thanks to the transport of goods by road. Unlike the other modes, the road had not regulated, by an international convention, the settlement of a contract in an imperative form. This is what was achieved in 1956, by the United Nations and the collaboration of Unidroit, IRU and ICC The scope of the CMR has expanded over 60 years to currently cover all of Europe, Maghreb and a large part of Asia, by the effect of the connecting factor. Doctrine and case law have accompanied this general application since required. Now, it is necessary to consider in the future after the balance - positive -, the gaps : how to manage the consequences of the contractual integration of road transport in a "combined" logistics operation ? Is the CMR still up to date ? How to save the contractual place of the roadcarrier?
