- Abstract
Council Directive 2014/60 on the restitution of cultural property has led to the revision of the Directive 93/7 (EC) of 16 March 1993. This text introduced a procedure for the return of national treasures exported illegally from one Member State to another Member State after 1 January, 2003. This mechanism was close to one of the two components of the UNIDROIT Convention. However, it was found ineffective in the project against illicit trafficking. The new text strengthens the protection of national treasures of states. We can observe movements of convergence between this texte and the instruments of international law, particularly the 1995 UNIDROIT Convention. This movement is clear with the introduction of the obligation of due diligence.
