ENVIRONMENTAL CONTAMINATION EVIDENCE AND JUST COMPENSATION: TAKING ISSUE WITH RESTRAINTS ON THE ADMISSIBILITY OF EVIDENCE IN EMINENT DOMAIN PROCEEDINGS.
- Authors
Lindeman, Matthew P.
- Abstract
In this article the author discusses the ruling of the Minnesota Supreme Court regarding the Moorhead Economic Development Authority v. Anda court case. He relates that Anda's case is an example of eminent domain issues wherein courts struggled to interpret the evidence of environmental contamination when presenting the just compensation. He argues that restrictions on eminent domain must be implemented in the U.S. and state's constitutions to protect property owners from sovereign's power.
