- Abstract
In this article we critically discuss the term »dangerousness« as an indispensable prerequisite for indeterminate preventive detention of mentally ill offenders in Germany and Austria. Particularly, the required nexus between a specific mental disorder and having committed a serious crime on the one hand and between the same mental disorder and the risk of further serious reoffending on the other hand is critically reviewed. Recent research data don't support a strong relationship between most mental disorders and either of those factors. Taking these findings into account and respecting the limited predictive power of even the best risk assessments - particularly against the background of constitutional rights -, the legal framework should make sure that indeterminate preventive detention measures will only be applied as an ultima ratio strategy.
