- Abstract
The article discusses the ongoing efforts to close the Guantánamo Bay Detention Facility, which was established in response to the 9/11 attacks. Despite the expressed desire of three presidents to close the facility, it remains open due to various factors such as a failure of will, logistical challenges, and legal obstacles. However, there have been recent developments that suggest progress towards closure, including a reduction in the detainee population and efforts to transfer cleared detainees to other countries. The military commissions established to try detainees have faced significant challenges, particularly regarding the admissibility of evidence obtained through torture. While progress has been slow, there are signs of movement towards resolution in some cases.
