- Abstract
In this article, the author discusses aspects of the fast sentencing program which allows a prosecutor offer a below-guidelines sentence in place of a defendant's prompt guilty plea. He argues that the discretion granted to sentencing courts to mitigate the fast-track disparity is more supportive of goals of the U.S. Congress. He cites that the approach is more close to the recent decision of the Supreme Court concerning the expansion of judicial discretion.
