- Abstract
The article discusses the issue of excessive pricing in competition law and the challenges faced by competition enforcers in determining when a company's profit margin becomes unfair and harmful. It highlights past cases, such as investigations into excessive pricing in the telecoms market and international roaming prices, as well as the Commission's decision against Aspen, a pharma company that had significantly increased prices for critical cancer medicines. The article also mentions the limited track record of excessive pricing cases and the potential for combining competition law and regulatory tools to address excessive prices in digital markets. The CoRe issue includes various perspectives on these topics, including the possibility of tackling high commission fees charged by digital gatekeepers as excessive pricing.
