- Abstract
An essay is presented on rights and state punishment. It explains how the rights theory affirms the need of revising the existing justification for the international criminal law. It discusses the insights of three authors who significantly contribute to the philosophical literature pertaining to state punishment including W.D. Ross in his "the Right and the Good," H.L.A. Hart in his "Prolegomenon to the Principles of Punishment," and John Simmons in his "Locke and the Right to Punish."
