- Abstract
The article discusses the author's views about the American Supreme Court cases Hall v. Florida and Moore v. Texas which deal with clinical definitions of intellectual disability, and it mentions independent judgment, a proposed solution involving underinclusiveness under the U.S. Constitution's Equal Protection Clause, and additional requirements for defendants. The case Atkins v. Virginia, which deals with substantial guidance on an intellectual disability definition, is examined.
