- Abstract
The article focuses on the U.S. Circuit Court's decision in United States v. Jacques. It discusses the benefits of local self-government, as its localized decisions are much better accurate than the political government. It informs that self government is effective only if it makes difficult decisions and imposes the ultimate penalty for the criminal offenders. It proposes that the Jacques case was unusual as it prohibited the U.S. Eighth Amendment Clause against the capital punishment.
