- Abstract
A decade ago, the Government asked the Parliament, when discussing the Bill on cemeteries, human crematoria and funeral services, to take into account the need to clarify the situation in which, in some areas of the country, there are graves in the courtyards / gardens of isolated residences. The bill became the Law no. 102/2014 which does not contain any express reference to such graves. Meanwhile, press articles continue to report the custom of burial not in cemeteries, usually due to their lack, but on private estates for the most part situated in isolated areas. That is why this brief study aims to analyze the legality of these burials. The two main reasons identified for the perpetuation of this custom are the lack of a cemetery in the settlement and the rugged relief that allows neither the establishment of a cemetery nor the easy transport of the coffin. Although according to the law such burials are illegal and can be sanctioned with a fine, as well as the forced exhumation and reburial in a cemetery, in practice such sanctions are rarely enforced since only a neighbor would complain of the graves’ vicinity and they rarely do since they usually follow the same custom.
