- Abstract
The article reports on the resolution of the legal case of Marilyn Vann vs. Dirk Kempthorne. In the case, Marilyn Vann, a Cherokee Indian and descendant of freed slaves, had filed a lawsuit that challenged the U.S. federal government's ratification of a 2003 tribal election that disenfranchised her and other slave descendants. The Court of Appeals affirmed part of Vann's lawsuit, which was related to her tribe's sovereign immunity, and reversed another part.
