TAMING THE WILD WEST: AN EXAMINATION OF PRIVATE STUDENT LOAN CONSOLIDATION COMPANIES' VIOLATIONS OF § 43(A) OF THE LANHAM ACT BY USING TRADE NAMES AND LOGOS THAT CLOSELY RESEMBLE THOSE USED BY THE UNITED STATES DEPARTMENT OF EDUCATION.
- Authors
Larson, Joseph A.
- Abstract
The article discusses student loan consolidation companies (SLCCs) that use trade names and logos resembling those of the federal government. It is said that these SLCCs should be held liable for trademark infringement under § 43(a) of the Lanham Act, which protects consumers from confusion as to the affiliation and services of the mark's owner. It is suggested that the Congress enact an amendment to the Higher Education Act that prohibits this type of false advertising by SLCCs.
