European Community Product Liability Directive -- Comments Requested.
- Abstract
The British Department of Trade and Industry recently issued a consultative document seeking views on the implementation of the European Commission Product Liability Directive. The document adopted on July 25, 1985, will make producers and importers throughout the common market strictly liable for damage caused by defects in their products. The development risks defence provides that a producer will not be liable under the Directive if he can prove that the state of scientific and technical knowledge at the time when he put the product into circulation was not such as to enable the existence of the defect to be discovered.
