- Abstract
Until very recently, the time that women invested in the Women’s Social Service (1937-1978) did not count towards reaching the minimum contribution period required to access early or partial retirement, something that, however, was always taken into account with the time that men served in mandatory military service or alternative social service. This discriminatory treatment was corrected by the Supreme Court in 2020. Ruling No. 115/2020 had great practical significance, as it led the Higher Court of Justice to recognize this same right for the Passive Classes Regime and the legislature to modify the legal regime of early and partial retirement (arts. 207, 208 and 215 of the General Law on Social Security). With this application of a gender perspective, one of the numerous historical discriminations that women have suffered in the workplace and in the Social Security system is eliminated, contributing to advancing towards a more just and egalitarian society.
