- Abstract
The article discusses the benefits and losses of the Citizens Protection Act of 1998 (CPA) with reference to the U.S Courts of Appeals case United States v. Hammad based on precharge investigatory communications. Topics discussed include the "Thomburgh Memo"' and the "Reno Regulation," which together comprised the U.S. Department of Justice's (DOJ) reaction to Hammad, the legislative debate leading to the CPA and DOJ's claim of authority over the no-contact rule for federal prosecutors.
