- Abstract
This paper aims at presenting some considerations on the Labour Code regulations concerning the probationary period. Based on the intuitu personae character of the individual employment agreement, I took into account the necessity of assessing in concreto some professional and personal skills, traits or features that are characteristic of employees and employers. In this context, the regulations of the probationary period within the employment agreements are objectionable. At the same time, contrary to appearances, we found that the regulation of the probationary period for persons with disabilities is not drawn up, in some cases, such as to help these people in concluding a labour agreement.
