- Title
FEARING THE UNITED STATES: RETHINKING MANDATORY DETENTION OF ASYLUM SEEKERS.
- Authors
Johnson, Kristen M. Jarvis
- Abstract
The article challenges the policy and regulations behind mandatory detention for defensive asylum seekers in the U.S. It suggests that Congress and the Department of Homeland Security (DHS) should implement thorough and efficient credible fear interviews, define clear parole guidelines and use humane detention alternatives. The failure of the current asylum laws and regulations to strike a balance between the U.S.' international obligations to defend refugees with recent national security efforts are discussed.
