- Title
Condom Availability in the Schools: Lessons from the Courtroom.
- Authors
Mahler, Karen
- Abstract
The article focuses on the opposition raised by parents to condom availability programs for students, which were started in high schools in the U.S. The High Court in Massachusetts refused to constitutionally challenge condom availability programs. However, parents opposed this program and requested the court to prevent the continuation of the program. Hence it was declared that a student could back out from the program. A similar situation was observed in New York and in Philadelphia, Pennsylvania, on the introduction of such programs. In Philadelphia, the program was implemented with an opt out provision for students. This provision enabled the continuance of the program but the Board of Education in New York City banned demonstrations on correct usage of condoms.
