- Abstract
The article presents "Denials of Benefits Recast as Breaches of Fiduciary Duty," by Nancy G. Ross and Shannon M. Barrett, published in the July-August 2000 issue of "Profit Sharing." It discusses the benefits for employees and their beneficiaries. New theories for seeking benefits under the U.S. Employee Retirement Income Security Act (ERISA) arose and threaten to increase litigation and administrative costs for plan sponsors following a ruling from the U.S. Supreme Court in 1996. The ruling in the case between Varity Corp. and Howe has given an opportunity to individual claims for breaches of fiduciary duty based on alleged misrepresentations in benefit entitlement.
