- Title
DUKES V. WAL-MART: THE EXPANSION OF CLASS CERTIFICATION AS A MECHANISM FOR RECONCILING EMPLOYEE CONFLICTS.
- Authors
Fanibanda, Bejan D.
- Abstract
The article focuses on the class-action lawsuit as tool for aggrieved workers to draw demands on employers in the U.S. It cites the decision of the U.S. district court in Dukes v. Wal-Mart Stores Inc. to certify a class of two million women in sexual discrimination lawsuit against Wal-Mart Stores Inc. The class-action lawsuit offers a means for employees to group their resources and force employers to handle employee grievances. However, it states that the use of the class-action suit to confront employers implicates all the costs, patience and risk of a lawsuit and potential trial.
