- Abstract
The article focuses on the decision of the U.S. in the case Martinez v. Ryan regarding the opportunity to end the Byzantine morass by establishing a constitutional right to post-conviction counsel. Topics discussed include development of habeas corpus as a tool to review state convictions, narrow exception to the rule of procedural default based upon post-conviction counsel's performance and Sixth and Fourteenth Amendments which embodies right to post-conviction counsel.
